The DocLine Terms of Service

1. Welcome to The DocLine and Acceptance of Terms

The DocLine, LLC (“The DocLine,” “DocLine,” “we,” “us,” or “our”) provides telemedicine services through our website at www.thedocline.com and www.doclinetelehealth.com, related mobile applications, and associated platforms (collectively, the “Sites” or “Platform”). These Terms govern your access to, use of, and interaction with the Sites and all services offered thereon (collectively, the “Services”).

By accessing, browsing, registering for, or using the Sites or Services in any manner, you (“you,” “your,” or “User”) affirm that you have read, understood, and agree to be legally bound by these Terms, our Privacy Policy, Notice of Privacy Practices (“NPP”), Telemedicine Informed Consent, and any other policies, agreements, or notices referenced or linked herein (collectively, the “Agreement”). If you are using the Services on behalf of another person (e.g., as a parent or guardian for a minor), you represent that you have the authority to bind that person to these Terms.

If you do not agree to these Terms or any part of the Agreement, you must immediately cease all use of the Sites and Services. Your continued use constitutes ongoing acceptance. These Terms form a binding contract between you and The DocLine.

The Services are intended solely for users physically located in Florida or Virginia during consultations, as required by state telemedicine regulations. Use outside these states is prohibited and may violate applicable laws.

2. Updates and Modifications to These Terms

We reserve the right to modify, amend, or update these Terms at any time and for any reason, including to reflect changes in laws, regulations, our Services, or business practices. Updated Terms will be posted on the Sites with the revised “Effective Date” at the top.

We will provide notice of material changes via posting on the Sites, at least 30 days in advance where practicable. Your continued access or use of the Sites or Services after the Effective Date of any changes constitutes your acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Services and may terminate your account as described in Section 13.

Pricing adjustments, including the end of temporary offers, will be communicated via updates to this page and your continued use constitutes acceptance.

It is your responsibility to review these Terms periodically. Historical versions of the Terms are available upon request by contacting docline@thedocline.com.

3. Description of Services

The Services enable virtual, non-emergency healthcare consultations via audio, video, or text-based communications with licensed healthcare professionals (“Providers”) who are independent contractors affiliated with The DocLine. The DocLine itself does not provide medical advice, diagnosis, or treatment; we facilitate access to Providers.

3.1 Scope of Services
  • Eligible Conditions: Services are limited to consultations for specific non-emergency conditions, such as urinary tract infections (UTI), anxiety, and similar ailments as listed on the Sites. Providers may recommend treatments, prescriptions (excluding controlled substances unless permitted by law), or referrals, but no guarantees are made regarding outcomes.
  • Telemedicine Nature: All interactions occur remotely. You must have a stable internet connection, compatible device, and appropriate environment for consultations. Technical requirements are detailed on the Sites.
  • Geographic Restrictions: Services are available only to users physically located in Florida or Virginia at the time of consultation, in compliance with state licensing laws (e.g., Fla. Stat. § 456.47 and Va. Code § 32.1-127.1:03). Location verification may be required.
  • Exclusions: Services are not for emergencies, chronic conditions requiring ongoing in-person management, or situations needing physical examinations. If your condition worsens or requires urgent care, seek immediate in-person medical attention or call 911.
3.2 Provider Independence

Providers are independent licensed professionals, not employees or agents of The DocLine. The DocLine does not control, supervise, or guarantee the quality, accuracy, or appropriateness of Provider services. You acknowledge that any provider-patient relationship is solely between you and the Provider.

3.3 Additional Features

Services may include educational resources, appointment scheduling, secure messaging, and record access, subject to availability and these Terms.

4. User Eligibility and Accounts

4.1 Eligibility Requirements

To use the Services, you must:

  • Be at least 18 years old or, if under 18, have a parent or legal guardian register and consent on your behalf.
  • Reside in Florida or Virginia and be physically present in one of these states during use.
  • Provide accurate, complete, and current information during registration.
  • Not be barred from using the Services under applicable laws.

The DocLine reserves the right to refuse or revoke access if you do not meet these criteria.

4.2 Account Registration and Security

Creating an account requires providing personal information (e.g., name, date of birth, contact details). You agree to maintain the accuracy of this information and update it promptly.

You are responsible for:

  • Safeguarding your login credentials (username, password).
  • All activities occurring under your account, whether authorized or not.
  • Notifying us immediately of any unauthorized access or security breach via docline@thedocline.com.

We may suspend or terminate your account for security reasons or violations, without liability.

During registration, you must acknowledge these Terms via a checkbox to proceed.

5. Fees, Payments, and Billing

5.1 Fee Structure

Services are self-pay only; The DocLine does not accept insurance, Medicare, Medicaid, or other third-party reimbursements. Fees, including any temporary promotional offers (such as our launch pricing), are displayed on the Sites prior to booking and are charged per consultation or service. All offers are temporary and subject to change without notice; please reference the current terms on this page or our dedicated Pricing and Offers section for the most up-to-date details. As outlined in the Financial Consent Packet, fees are payable at the time of service, with no refunds after the consultation begins except for technical failures attributable to The DocLine. 5.2 Payment Process
  • Payments are processed via secure third-party processors (e.g., credit/debit cards, digital wallets).
  • You authorize The DocLine to charge the provided payment method for all fees incurred.
  • Fees are non-refundable except in cases of The DocLine-attributable errors (e.g., technical failures preventing service delivery), as determined in our sole discretion.
  • We may adjust fees with prior notice; continued use after changes constitutes acceptance.
5.3 Taxes and Additional Costs

You are responsible for all applicable taxes, surcharges, or fees. Prescriptions, lab tests, or follow-ups may incur separate costs from third parties, for which The DocLine is not responsible.

6. Privacy and Protected Health Information (PHI)

Your personal and health information is governed by our Privacy Policy and NPP, which detail how we collect, use, disclose, and protect data in compliance with HIPAA, Florida, and Virginia privacy laws.

  • PHI Uses: We may use or disclose PHI for treatment (e.g., sharing with Providers), payment (e.g., billing), healthcare operations (e.g., quality audits), or as required by law (e.g., public health reporting).
  • Security Measures: We employ reasonable safeguards, but no system is infallible; you acknowledge risks of data transmission.
  • Your Rights: As outlined in the NPP, you may access, amend, or restrict PHI uses.

7. Electronic Communications and Consents

By using the Services, you consent to receive electronic communications from The DocLine, including emails, SMS texts, push notifications, and in-app messages for transactional purposes (e.g., appointment confirmations, health reminders, updates).

  • SMS Specifics: Standard messaging rates apply. To opt out of SMS, reply “STOP” to any message or contact docline@thedocline.com. Opting out may limit Service functionality.
  • Recording: Consultations and calls may be recorded for quality, training, or legal purposes. You consent to such recordings but may request non-recording in advance.
  • Revocation: You may revoke consent to non-essential communications at any time, but essential notices (e.g., security alerts) will continue.

8. Intellectual Property Rights

8.1 Ownership

The Sites, Services, and all content therein (e.g., text, graphics, logos, software) are owned by The DocLine or its licensors and protected by copyright, trademark, and other intellectual property laws.

8.2 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Sites and Services for personal, non-commercial purposes, subject to these Terms.

8.3 Restrictions

You may not copy, modify, distribute, sell, or create derivative works from any content without our prior written consent. Violations may result in account termination and legal action.

9. User Conduct and Prohibited Activities

You agree to use the Services lawfully and responsibly. Prohibited actions include, but are not limited to:

  • Submitting false or misleading information.
  • Harassing, threatening, or impersonating others.
  • Uploading viruses, malware, or harmful code.
  • Interfering with the Sites’ functionality or security.
  • Using automated tools (e.g., bots) to access content.
  • Violating third-party rights or applicable laws.

We monitor usage and may investigate violations, cooperating with authorities as needed.

10. Disclaimers of Warranties

THE SITES AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, secure, or meet your expectations. Advice from Providers is not guaranteed to be accurate or complete; always consult additional sources if needed.

11. Limitation of Liability

TO THE MAX EXTENT PERMITTED BY LAW, THE DOCLINE, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SITES OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability shall not exceed the fees you paid to us in the twelve (12) months preceding the claim. This limitation does not apply to liability for death, personal injury caused by gross negligence, or willful misconduct, where prohibited by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless The DocLine, its affiliates, officers, directors, employees, agents, and Providers from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising from:

  • Your violation of these Terms or applicable laws.
  • Your misuse of the Services.
  • Any content you submit or transmit.
  • Disputes between you and Providers.

We reserve the right to assume control of any defense, at your expense.

13. Termination and Suspension

We may suspend or terminate your access to the Sites or Services at any time, with or without cause or notice, including for violations of these Terms or legal requirements.

Upon termination:

  • Your license to use the Services ends immediately.
  • We may delete your account and data, subject to record retention laws.
  • Surviving provisions (e.g., disclaimers, limitations, indemnification) remain in effect.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms and any disputes arising hereunder shall be governed by the laws of the State of Florida, without regard to conflict of law principles.

14.2 Dispute Resolution

Any disputes shall be resolved exclusively in the state or federal courts located in Osceola County, Florida. You consent to personal jurisdiction and venue therein, waiving any objections.

No class actions, arbitrations, or consolidations are permitted; all claims must be brought individually.

15. Miscellaneous Provisions

15.1 Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force.

15.2 Waiver

No waiver of any term shall be effective unless in writing and signed by us. Failure to enforce a provision does not constitute a waiver.

15.3 Assignment

You may not assign these Terms without our consent. We may assign them freely, e.g., in a merger or acquisition.

15.4 Force Majeure

We shall not be liable for delays or failures due to events beyond our reasonable control, including acts of God, pandemics, wars, strikes, or technical failures.

15.5 Entire Agreement

These Terms, together with referenced policies, constitute the entire agreement between you and The DocLine, superseding all prior understandings.

15.6 Notices

Notices to you may be sent via email or posted on the Sites. Notices to us must be sent to docline@thedocline.com or our registered address.

15.7 Third-Party Beneficiaries

Providers are intended third-party beneficiaries of Sections 3, 10, 11, and 12.
